EduTribe Website Terms and Conditions (Terms)

Interpretation and Definitions

The meaning of the words identified in the section titled Definitions apply to these Terms. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms:

Content means anything posted or uploaded to the EduTribe website including but not limited to resources, surveys, content, feedback etc.

EduTribe means [One Tree Community Services Inc].

Feedback Policy means the written feedback policy provided by EduTribe to the User from time to time.

Members means individuals who have joined EduTribe through the website and have access to the available resources.

Organisation means One Tree Community Services Inc.

Services means any products or services available for use while on the EduTribe website.

Terms means the terms and conditions for use of the EduTribe website.

User Accounts means the information you provide to join as a Member of EduTribe.

User means a member of EduTribe or anyone using or accessing the EduTribe website.

Acknowledgment

These Terms govern the use of the EduTribe website and the rights and obligations of all Users.

Your access to and use of the EduTribe website is conditioned on your acceptance of and compliance with these Terms. The Terms apply to anyone who accesses or uses the Services provided.

By accessing or using the EduTribe website you agree to be bound by these Terms. If you disagree with any part of these Terms, then you may not access the EduTribe website.

Your access to and use of the EduTribe website is also conditioned on your acceptance of and compliance with the EduTribe Website Privacy Policy (Privacy Policy). The Privacy Policy outlines how the Organisation uses and discloses your personal information and your privacy rights when you use the EduTribe website. User Accounts

The membership information you provide to join EduTribe must be accurate, complete and current. Failure to meet this requirement constitutes a breach of the Terms, which may result in immediate termination of your membership account.

You are responsible for safeguarding your password to any third party. You must advise us immediately upon becoming aware of any breach of security or unauthorised use of your account.

User Accounts are setup using a personal email address. You may not use an email address of another person or entity. Any email address must be lawfully available for you to use.  You must not use an email address that is subject to any rights of another person or entity other than you without appropriate authorisation. You may not use a false email address or provide other false information to setup a User Account.

Content

If the EduTribe website allows you to post Content you are responsible for the Content that you post to the EduTribe website, including its legality, reliability, and appropriateness.

By posting Content to the EduTribe website, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the EduTribe website. You retain all your rights to any Content you submit, post or display on or through the EduTribe website and you are responsible for protecting those rights. You agree that the Organisation has the right to make Content you have provided available to other Users of the EduTribe website, who may also use your Content subject to these Terms.

You represent and warrant that:

  1. the Content is yours (you own it) or you have the right to use it;
  2. you grant us the rights and license as provided in these Terms; and
  3. the posting of your Content on or through the EduTribe website does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

Content Restrictions

The Organisation is not responsible for the Content of the EduTribe website Users. You expressly understand and agree that you are solely responsible for the Content and for all activity that occurs under your account, whether done so by you or any third person using your account.

You may not transmit any Content that is unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene or otherwise objectionable. Examples of such objectionable Content include, but are not limited to, the following:

  • Unlawful or promoting unlawful activity.
  • Defamatory, discriminatory, or mean-spirited Content, including references or commentary about religion, race, sexual orientation, gender, national/ethnic origin, or other targeted groups.
  • Spam, machine – or randomly – generated, constituting unauthorised or unsolicited advertising, chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling.
  • Containing or installing any viruses, worms, malware, trojan horses, or other Content that is designed or intended to disrupt, damage, or limit the functioning of any software, hardware or telecommunications equipment or to damage or obtain unauthorised access to any data or other information of a third person.
  • Infringing on any proprietary rights of any party, including patent, trademark, trade secret, copyright, right of publicity or other rights.
  • Impersonating any person or entity including the Organisation and its employees or representatives.
  • Violating the privacy of any third person.
  • False information and features.

The Organisation reserves the right, but not the obligation, to, in its sole discretion, determine whether any Content is appropriate and complies with the Terms, refuse or remove this Content. The Organisation further reserves the right to make formatting and edits and change the manner of any Content. The Organisation can also limit or revoke the use of the EduTribe website if you post such objectionable Content. As the Organisation cannot control all Content posted by Users and/or third parties on the EduTribe website, you agree to use the Edutribe website at your own risk. You understand that by using the EduTribe website you may be exposed to Content that you may find offensive, indecent, incorrect or objectionable, and you agree that under no circumstances will the Organisation be liable in any way for any Content, including any errors or omissions in any Content, or any loss or damage of any kind incurred because of your use of any Content.

Content Backups

Although regular backups of Content are performed, the Organisation does not guarantee there will be no loss or corruption of data.

Corrupt or invalid backup points may be caused by, without limitation, Content that is corrupted prior to being backed up or that changes during the time a backup is performed.

The Organisation will provide support and attempt to troubleshoot any known or discovered issues that may affect the backups of Content. But you acknowledge that the Organisation has no liability related to the integrity of Content or the failure to successfully restore Content to a usable state.

You agree to maintain a complete and accurate copy of any Content in a location independent of the EduTribe website to meet your purpose.

Copyright

We respect the intellectual property rights of others. We will respond to any claim that Content posted on the EduTribe website infringes a copyright or other intellectual property infringement of any person.

Advise us in writing at information@onetree.org.au and the matter will be investigated.

You may be held accountable for damages (including costs and attorneys’ fees) for misrepresenting that any Content is infringing your copyright.

All Content developed by the Organisation for the EduTribe website is deemed to be copyright. Only individual Members of the EduTribe website can use this Content for their sole purposes. Businesses, services or other organisations can use the Content in their operations if 80% of their employees are individual Members of the EduTribe website.

Members can adapt and change the Content and apply their logo. Once changes have been made to the Content the Organisation cannot guarantee that it meets the purpose for which it was intended.

Availability, Errors and Inaccuracies

We are constantly updating Content and offerings of products on the EduTribe website. The products available on the EduTribe website may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information.

We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

Intellectual Property

The EduTribe website and its Content (excluding Content provided by you or other Users), features and functionality are and will remain the exclusive property of the Organisation.

The EduTribe website is protected by all relevant copyright, trademark, and other laws.

Our trademarks and trade address may not be used in connection with any product or service without the prior written consent of the Organisation.

Your Feedback to Us

You assign all rights, title and interest in any Feedback you provide the Organisation. If for any reason such assignment is ineffective, you agree to grant the Organisation a non-exclusive, perpetual, irrevocable, royalty free, worldwide right and license to use, reproduce, disclose, sub-license, distribute, modify and exploit such Feedback without restriction.

Complaints

The Organisation will respond to any complaints related to the EduTribe website in accordance with the Organisation’s Feedback and Complaints Policy. Complaints and to obtain a copy of the Feedback and Complaints Policy is via email to information@onetree.org.au.

We employ the use of cookies. By using EduTribe website you consent to the use of cookies in accordance with One Tree Community Services privacy policy.

Most of the modern-day interactive web sites use cookies to enable us to retrieve user details for each visit. Cookies are used in some areas of our site to enable the functionality of this area and ease of use for those people visiting. Some of our affiliate / advertising partners may also use cookies.

User Comments

This Agreement shall begin on the date hereof.

Certain parts of this website may offer the opportunity for users to post and exchange opinions, information, material and data (‘Comments’). The Organisation does not screen, edit, publish or review comments prior to their appearance on the website. Comments do not reflect the views or opinions of the Organisation, its agents or affiliates. Comments reflect the view and opinion of the person who posts such view or opinion. To the extent permitted by applicable laws the Organisation shall not be responsible or liable for the Comments or for any loss cost, liability, damages or expenses caused and or suffered because of any use of and/or posting of and/or appearance of the Comments on the EduTribe website.

The Organisation reserves the right to monitor all Comments and to remove any comments which it considers in its absolute discretion to be inappropriate, offensive or otherwise in breach of these Terms.

You warrant and represent that:

  1. You are entitled to post the Comments on the EduTribe website and have all necessary licenses and consents to do so.
  2. The Comments do not infringe any intellectual property right, including without limitation copyright, patent or trademark, or other proprietary right of any third party.
  3. The Comments do not contain any defamatory, libellous, offensive, indecent or otherwise unlawful material or material which is an invasion of privacy.
  4. The Comments will not be used to solicit or promote business or custom or present commercial activities or unlawful activity.
  5. You hereby grant to the Organisation a non-exclusive royalty-free license to use, reproduce, edit and authorise others to use, reproduce and edit any of your comments in any and all forms, formats or media.

Hyperlinking to our Content

The following organisations may link to the EduTribe website without prior written approval:

  1. Government agencies.
  2. Search engines.
  3. News organisations.
  4. Online directory distributors when they list us in the directory may link to the EduTribe website in the same manner as they hyperlink to the websites of other listed businesses.
  5. Accredited businesses excluding any that are soliciting or fundraising.

Organisations that are approved to hyperlink to the EduTribe website content may link to our home page, to publications or to other information so long as the link:

  1. Is not in any way misleading.
  2. Does not falsely imply sponsorship, endorsement or approval of the linking party and its products or service.
  3. Fits within the context of the linking party’s site.

The Organisation may consider and approve in its sole discretion other link requests if it is determine that the link would not reflect unfavourably on the Organisation.

Anyone interested in linking to the EduTribe website, must notify us by sending an e-mail request to info@onetree.org.au. Allow 2-3 weeks for an authorised person to follow up on your request.

Approved organisations may hyperlink to the EduTribe website as follows by use of:

  1. Our corporate name.
  2. The web address being linked to.
  3. Any other description of the EduTribe website or material being linked to that makes sense within the context on the linking party’s site.

To use the EduTribe logo as a link from a website a trademark license agreement is required.

Iframes

When representing the EduTribe website the presentation or appearance (including frames) may not be altered in any way without approval in writing from the Organisation beforehand.
